SRINAGAR, Sept 3: The High Court today directed Insurance Companies to provide survey reports to the claimants (assured) within 15 days wherever reports have not been provided to them.
The Division Bench of Justice M H attar and Justice Ali Mohammad Magrey directed: “On failure of providing copy within two week time, Manager, insurance company shall be personally responsible for violating the court orders.”
Court while deciding about 400 claims of those whose business establishments that have been damaged in last year’s devastating floods passed slew of directions upon the insurances companies.
The claimants had approached the High Court after they were denied insured amount with certain disputes between the claimants (assured) and companies.
Court to those claimants who have received survey reports, granted liberty to them to approach the concerned forum for redressal of their grievances in terms court order dated October 2014.
For those who have not intimated the Insurance Company about the loss of their establishments, court also granted liberty to those claimants to approach the concerned Divisional Forum or State Commission and directed for excluding the time which they have consumed in High Court.
Court also granted liberty to those claimants (assured) whose claims have been rejected by the insurance company on any ground including that of not filing the claim within time. “Such applicants would be at liberty to challenge the decision so taken by the insurance company before the appellate forum”, court said.
Court in other relief to claimants directed the insurance companies to pay the amount within four week time wherein they (companies) have admitted the claim but did not pay the amount.
Court on October 30 last year had observed that “People are in pain, they have suffered mental agony and they have faced trauma.” The bench observed: “It is not for the assured to chase the insurance company all the time. Therefore, the insurance company shall contact all such claimants in whose favour cheques have been prepared” and subsequently had directed the insurance companies instead for waiting assured, the company could contact the assured and handover the cheques to them.
