DB directs JDA VC to produce record or appear in person

JAMMU, Apr 3: In a petition filed by Ashok Singh and others seeking quashment of advertisement of JDA regarding allotment of plots in village Birpur, Division Bench of High Court comprising Justice Mohammad Yaqoob Mir and Justice BS Walia today directed the Vice-Chairman of Jammu Development Authority to produce record on next date of hearing or appear in person.
The petitioners are seeking declaration from the JDA to the extent that notification doesn’t and shall not relate to the land measuring 215 kanal in Khasra No.1845/1734, which is in possession of the petitioners and other land belonging to them in the village.
After hearing Advocate RS Thakur appearing for the petitioners whereas Advocate Adarsh Sharma appearing for the JDA, DB observed, “the counsel for the petitioners has stated that land measuring 215 kanals covered under Survey No 1845/1734 situated at village Birpur has never been transferred to the JDA and same has been in continuous possession of the petitioner since the times immemorial and they have certain rights which have accrued upon them in view of the latest legislation”.
Division Bench pointedly asked counsel for the JDA to show as to whether this land with specifications, as claimed by the petitioner to be in their possession, has been transferred to the JDA. Advocate Adarsh Sharma sought some time to produce the orders/ record.
Accordingly, Division Bench granted the time and ordered that in case of non-compliance the Vice-Chairman of JDA shall remain present on next date of hearing to explain his position.
