It is being experienced in the past that most of the accused booked under NDPS Act are discharged due to faulty investigation etc.In this context, kindly refer DE dated 17th Feb news” 2 smugglers discharged as the police fails to produce FSL report”.It is very surprising that the investigation was completed in the absence of the FSL report which is mandatory under NDPS Act. In spite of issuance of court directions, time and again, to produce the FSL report in the case, the same was not produced resulting in discharge of the accused.It shows the lackadaisical approach of the investigating as well as the FSL authorities that no importance was given while dealing with drug menace which is causing harm to our society in general and youth in particular.
At the same time, it is enjoined upon the senior police officers to ensure that no citizen is falsely implicated under NDPS Act.Since the accused have been discharged due to non production of FSL report in the above case, Senior Officers of the FSL Jammu are also requested to investigate as to whether the samples collected were actually received by FSL Jammu or not. And if received, what was the fate of these samples.Extra efforts must be made to expedite FSL reports in a time bound manner so that such instances may not repeat in future.
