JAMMU, Dec 17: The Jammu and Kashmir Department of Law, Justice and Parliamentary Affairs has issued a stern warning to notaries across the Union Territory to stop illegally registering property documents, specifically Sale Agreements and those involving State land.
The Government clarified that while notaries are authorized to verify and attest signatures, they do not possess the legal power of “Registering Authorities” under the Registration Act, 1908.
Authorities noted that some notaries have been attesting property deals in the absence of the parties involved or dealing with State land, which is strictly prohibited and legally void.
“Any notary found bypassing these legal boundaries will be charged with gross professional misconduct, potentially leading to the permanent removal of their name from the official Register of Notaries,” warned the Government.
