Srinagar, Aug 27: The High Court has issued bailable warrant against the Sub Divisional Magistrate (SDM) Pahalgam for securing his presence before the court in contempt proceedings on next date.

Justice Rahul Bharti has directed for issuing bailable warrants against the SDM Pahalgam for securing his presence before the court on September 1 as he has failed to comply with earlier court orders.
The court has directed to issue bailable warrants against SDM Pahalgam for an amount to Rs. 25000 for securing his presence before the court on next date of hearing.
“The Registrar Judicial, Srinagar, is directed to issue the bailable warrants addressed to the Senior Superintendent of Police, Anantnag for service upon the Sub-Divisional Magistrate, Pahalgam and return the process by or before the next date of hearing”, read the order.
The court has noted that on previous order, it was clarified that in the event of non-submission of compliance report from the end of Sub-Divisional Magistrate, Pahalgam, he shall remain present before this court. “There is no compliance report which has come from the Sub-Divisional Magistrate, Pahalgam’s end. There is also no personal appearance of Sub-Divisional Magistrate, Pahalgam today before this court”, the court said
Chief Wildlife Warden, Regional Wildlife Warden, Kashmir, Deputy Conservator of Forests Social Forestry Deptt, Deputy Commissioner, Anantnag and other officers already submitted that in compliance to the judgment of this court, the indent for the acquisition of the land has been placed with Deputy Commissioner Anantnag and funds have already been released in favour of land owners.
The court was apprised that Sub-Divisional Magistrate, Pahalgam, has to proceed further on the Indent placed before him and has to issue notification under the Act and it is Sub Divisional Magistrate, Pahalgam, who now has to proceed further in terms of the Indent.
The claim of the petitioner-land owners quo the land in possession and the respondent-Wild Life Department had reported that the land measuring 01 Kanal 17 Marlas situated at Laripora Pahalgam, stands occupied by Wildlife Department for Deer Park Pahalgam in 2003, without following due process of law.
The Deputy Commissioner Anantnag has asked the Chief Wildlife Warden J&K, Srinagar vide communication dated 30.11.2019, to place indent with respect to the suit land before the Collector, enabling him to initiate the process of land acquisition in order to comply with the order of the High Court.
