SRINAGAR, July 8: High Court today stayed the interim arrangement of four Joint Directors in Agriculture Department.
Justice Dhiraj Singh Thakur after issuing notice to the Commissioner Secretary to Government Agriculture Production Department also stayed the Order No. 115-Agri of 2014 dated June 20, 2014 so far as it pertains to four persons who were made in charge Joint Director vide this order.
The petitioner through his counsel Bashir Ahmad Bashir (Senior Advocate) is claiming to be the senior most District Level Officer and private respondents are junior to him, as such have a right to be considered for the promotion of next higher post of Joint Director in the department.
The bench after hearing the counsel observed: “That Government is entitled to make an interim arrangement to overcome the exigencies of work but while making such interim arrangements case of all eligible candidates should be considered to bring it in conformity with principles of fairness as applied in Article 14 of the constitution.”
Expressing the malafides in the impugned order the court further said that it does not show that case of the petitioner has been ever considered for such adjustment nor does it show the respondents were better suited for the post and ignoring the seniority of the petitioner.
