Srinagar, Apr 14: The Central Administrative Tribunal (CAT) has sought intervention of the Chief Secretary in releasing the withheld salary of a retired employee as the concerned officials have turned the deaf ear to the directions of the court.
The bench of D S Mahara has directed the Chief Secretary to look into the matter and also directed the Secretary of Tourism Department to ensure in releasing the salary of its employee who has already superannuated from the services in February 2025 but his salary has not been released for the months of December 2024 to February 2025.
Advocate S R Hussain on behalf of the applicant-Mohammad Yousuf Tantray submitted before the court that though he has already superannuated on 28.02.2025, he has not been paid the salary for the months of December 2024 to February 2025.
He apprised the bench that vide order dated 28.02.2025, the Finance Department was directed to release his withheld salary and the matter was further ordered to be listed for further hearing on 26.03.2025. When the matter came up for hearing on 26.03.2025 but no payment was made to the applicant-Tantray for the period.
The Principal Secretary, Finance, was also directed to remain present before the CAT on that date, however, an application has been moved by the Government counsel seeking exemption from his personal appearance, which was allowed and the personal appearance of Principal Secretary, Finance was exempted.
However, the grievance of the applicant-Tantray regarding non-payment of salary remains unaddressed. The Chief Secretary, Union Territory of Jammu & Kashmir, is also directed to look into the matter and direct the concerned Secretary/officials to ensure that the salary for the period December 2024 to February 2025 is paid to the applicant before the next date of hearing, failing which the inaction shall be viewed seriously”, the CAT directed with warning.
