JAMMU, Mar 29: High Court of Jammu & Kashmir and Ladakh has quashed the orders of Judicial Magistrate 1st Class (Forest Magistrate) Jammu whereby directions were issued for registration of FIR against proprietor of Kangra Fort Kamal Nain Singh for allegedly possessing fake and fabricated State Subject certificate.
“The petitioner has placed on record a copy of the final report submitted by the State Subject Commission according to which after thorough enquiry into the matter it was found that the State Subject of the petitioner is genuine”, Justice Sanjay Dhar said, adding “this aspect of the matter needs to be looked into by the Crime Branch before submitting its report with the Magistrate”.
Accordingly, High Court has quashed impugned orders dated 11.03.2014 and 13.03.2014 passed by the Magistrate with the direction that Magistrate after recording the preliminary evidence of the complainant and after taking into consideration the report that may be placed on record by the Crime Branch proceed further in the matter in accordance with the procedure prescribed under Chapter XVI of J&K CrPC.
