Court acquits accused facing trial in murder case

JAMMU, Sept 10: Principal Sessions Judge Jammu, Kartar Singh has acquitted   Raj Kumar alias Raju, son of Thoru Ram of Kana Chak, who was facing trial in murder case, as prosecution failed to prove its case.
According to the police case, on  September 3, 2011, Shakuntla Devi, wife of Bal Krishan was found dead under suspicious circumstances and inquest proceedings under Section 174 CrPC were initiated. The investigation officer recorded the statement of Bal Krishan in which he stated that the accused was having enmity with him and his wife regarding land and he used to threaten them of dire consequence.
On August 16, 2011, his wife went missing along with cattle and on search her dead body was recovered from the canal. During investigation, it came to fore that the accused was having enmity with the deceased and her husband on account of land dispute and he committed her murder. The accused was arrested and on his disclosure statement sharp edged weapon was recovered.
After hearing Advocate D K Khajuria appearing for the accused whereas Public Prosecutor Shabir Choudhary for the State, Principal Sessions Judge observed, “not even a single witness has supported the prosecution story.  The evidence on the record is not sufficient to prove that it was the accused who had committed the murder of the deceased. The record reveals that the alleged occurrence took place on August 16, 2011 whereas the FIR was registered in the police station on September 3, 2011”.
“All the witnesses examined by the prosecution have stated nothing against the accused. Moreover, no blood stains were found on the sharp edged weapon. Prosecution witness Thoru Ram is the father-in-law of the deceased and he has categorically stated that the accused was not having enmity with his sister-in-law. In view of such circumstance on record, there is no incriminating evidence which is required to be explained by the accused under Section 342 CrPC”.
With these observations, court acquitted the accused of the charges leveled against him.
