JAMMU, Mar 31: In an execution petition by virtue of which Assistant Executive Engineer (Electrical Inspector) Electric Mobile Unit -1, Old Secretariat, Jammu, Assistant Executive Engineer, EM & RE, Sub-Div-II, Shastri Nagar, Jammu and other Judgment debtors were mandated by virtue of decree dated 11.10.2017 to refund an amount of Rs. 84,200 to decree holder, the court of Sub-Judge (CJM), Jammu directed the judgment debtors to make payment of the amount to decree holder consistent with the terms of the decree by or before next date of hearing failing which not only coercive process for satisfying the decree be invoked but judgment debtors be also put on notice to face consequences provided under Order 21 Rule 32 of CPC which may include attachment of their official account or detention in civil prison or both.
Noting that despite service, Judgment debtors did not cause appearance and holding that decree is the fruit of the litigation envisaging no frustration in realization of the same, the court further observed – “The disposition on the part of Judgment debtors by virtue of which they neither chose to contest the decree under execution nor are they interested in complying the same – indeed is a testament of their in-difference that they have trotted out in the matter in hand warranting passing of appropriate order” adding that copy of this order shall go to judgment debtors for compliance by or before next date.
