JAMMU, Mar 15: After procuring the attendance of accused in case titled “Robkar, through Court of Sessions, Judge, Jammu Vs. Dr. G.N Bhat” in a matter pertaining to year 1995, the court of Chief Judicial Magistrate, Jammu today directed that accused be kept in judicial custody till further orders at District Jail Amphalla, Jammu.
It is pertinent to mention here that the then Sessions Judge, Jammu in the year 1995 filed a complaint under Section 195 read with Section 479-A of Cr.P.C against accused who happens to be a doctor by profession – for fabricating false evidence in judicial proceedings.
After being admitted to bail way back, accused thereafter never appeared/participated in the proceedings.
Reflecting on the conduct of the accused, court noted – “It is only once that accused caused appearance in the court and was admitted to bail and thereafter he did not turn up. Premier aspect which needs to be noticed therefore is that despite all this, accused eluded the process of law and successfully so – for nearly 27 years.” “Having regard to the totality of the circumstances and also taking note of ordeal with which presence of accused has been procured, it is deemed expedient that accused be directed to be kept in judicial custody till further orders at District Jail Amphalla Jammu. Matter has now been posted for appropriate proceedings with regard to framing of charge on next date,” the Court said.
