JAMMU, July 1: State High Court today directed the Jammu University to submit the case of the petitioner to the Committee consisting of Head of Faculty, Convener of Board of Studies and concerned HoD for re-evaluation of answer scripts of MBBS Final Prof-Part-II (Subsequent Session) Exam of the petitioner.
The direction was passed in a petition filed by Heena Naz, who submitted that despite having applied to the University for re-evaluation, the University did not allow the same compelling the petitioner to undergo fresh examination of practical/clinical subject, which she has already passed.
“The action of respondents in not permitting the re-evaluation of MBBS examination is illegal and arbitrary as the concession of re-evaluation is available to other graduate, post-graduate and professional courses as laid down under Chapter-XLI of statute and regulations governing examination”, Advocate F S Butt appearing for the petitioner submitted, adding “the respondents have allowed the concession of re-evaluation to similarly situated candidate”.
After hearing Advocate F S Butt for the petitioner whereas Advocate W S Nargal for the University of Jammu, Justice Ali Mohammad Magrey disposed of the petition with the direction to Jammu University to submit the case of the petitioner to the committee consisting of Dean of faculty, Convener of Board of studies and concerned HOD for re-evaluation and recommendation after petitioner furnishes an undertaking that she will abide by the verdict of the second evaluation whether it is to her advantage or otherwise.
“The process of re-evaluation and consideration shall be undertaken by the University Committee immediately and concluded within one month from the date of copy of this order is served upon them”, the High Court said.
