CAT directive to police on transfers

SRINAGAR, May 17: Central Administrative Tribunal (CAT) directed the police not to transfer its lower subordinate employees beyond the region and find out if the posts held by the aggrieved persons is a District Cadre Post or not.
Various persons who are working in Jammu Division in the police (Armed) as Followers in different battalions and have been assigned the job of scavenging, washing clothes, cleaning, cooking, repairs of shoes etc and are lowest paid employees of the Police Department.
Keeping in view of their low salary and nature of the job, the department fixed their posting within home town or in a district but not beyond the region. They stated that the transfer policy of the department is not applicable to them.
The Additional Director General of Police Armed J&K modified the transfer policy whereby conditions and norms governing the transfer of NGO and other employees has been applied to the lower subordinate (Followers) and subsequently made massive transfers posting as such compelled the petitioners to approach the CAT forum.
The CAT while disposing of the plea of aggrieved persons directed the police authorities to go into the question whether the post held by the petitioners is a District Cadre post or not and pass appropriate and speaking order in this regard within seven days. “Till then, if the applicants have not been relieved, they will not be relieved for a period of seven days”, CAT directed.
The direction followed after advocate Sheikh Hilal appearing for the petitioners submitted before the CAT that if the transfer in question is implemented the petitioners who are working in Jammu region or vice versa would face severe financial hardship as they will have to work either in Kashmir or Ladakh and there they will require new accommodation and other life supporting items which will be difficult for them to manage with their meager salary.
He further added that posts held by the petitioners is a District Cadre post as such the transfer policy does not apply on them. On the other hand counsel representing the department submitted that the applicants were transferred in accordance with rules and policy of the police department.
He further argued that the transfer of petitioners was made purely in the exigency of work and the transfer order does not violate any right of them and the plea filed by the petitioners is liable to be dismissed.
The ADG Armed on April 6 issued an order of transfer of more than 250 Followers of Armed Zone with immediate effect by modifying the transfer policy of 2014 to the extent that the conditions and norms shall also be applicable to the Followers of the Jammu wing as well.
