JAMMU, Sept 7: Principal Sessions Judge Jammu Sanjeev Gupta has dismissed the challan in a murder case after eight years and acquitted Mohd Younis Khan from the charges levelled against him.
According to the prosecution case, in the month of September 2011 Mohd Younis Khan committed the murder of one Ghulam Rasool over an old enmity. Accordingly, a case was registered at Domana Police Station.
After hearing Advocate AR Khan for the accused person, the Principal Sessions Judge observed, “considering the totality of the facts and evidence, in my opinion, the circumstances relied upon by the prosecution are not established by convincing evidence and they do not form a complete chain pointing to the guilt of the accused”.
“The prosecution has failed to prove its charge against the accused under Sections 302/201 RPC as such the case is dismissed and accused is acquitted of the charge”, the court said.
