KISHTWAR, Aug 2: Principal District Sessions Judge Kishtwar, M L Manhas has awarded seven years rigorous imprisonment and a fine of Rs 1000 each to Tariq Hussain, son of Mohd Sharief and Mansoor Ahmed, son of Mehraj Din, both residents of Noor Kewa Bounjwah Kishtwar in rape case.
According to the prosecution case, on September 8, 2010 two minor girls lodged a complaint with PP Jawalapur that they were raped by Tariq Hussain and Mansoor Ahmed when they (girls) were returning to their homes after attending marriage in the house of one Ghulam Rasool of Noor Kewa Bounjwah
Accordingly, a case was registered and after completing all the legal formalities of the case including the examination of scene of crime and collection and forwarding of evidence of expert opinion, both the prosecutrix were produced before Judicial Magistrate and their statements recorded under Section 164-A CrPC.
Later, police arrested both the accused and after completion of investigation presented charge sheet in the court of Principal and District Sessions Judge Kishtwar.
The court charge sheeted both the accused and on the conclusion of trial awarded 7 years rigorous imprisonment and a fine to the tune of Rs 1000 to each accused. While pronouncing the judgement, Principal District and Sessions Judge observed, “court cannot lose sight of the fact that crime against women and minor children is on increase as such the perpetrators of the crime must be dealt with iron hands”.
“Leniency in matters involving sexual offences is against public interest. Such types of offences are to be dealt with severity and iron hands. The act of accused is not only shocking but outrageous in contours”, the Court further observed.
