3 increments of Patwari withheld for misconduct

JAMMU, July 23: Financial Commissioner (Revenue) J&K has ordered withholding of three increments with cumulative effect of Rakesh Kumar, Patwari Akhnoor Khas after he was found guilty of misconduct.
In the month of May last year, a complaint was filed before the Deputy Commissioner Jammu alleging therein that Patwari failed to process mutation application for its attestation twice without any valid reason.
Accordingly, show-cause notice was issued to the official directing him to explain his position failing which suitable penalty will be imposed upon him for causing unnecessary trouble to the general public and breaching the time limit as envisaged under the Public Service Guarantee Act.
Though Rakesh Kumar replied to the show-cause notice yet the same was found to be unsatisfactory and accordingly Deputy Commissioner Jammu imposed a fine equivalent to one day’s salary on the official. In the month of January this year, Sub-Divisional Magistrate AKhnoor reported to the Deputy Commissioner that multiple complaints against Rakesh Kumar for harassment of the public and apathy towards his official duties were received.
Accordingly, Patwari was suspended and attached to the office of SDM Chowki Choura and SDM Jammu North was appointed as Inquiry Officer, who in his report submitted that conduct of Rakesh Kumar was unbecoming of a public servant. Therafter, DC Jammu initiated Regular Departmental Action against the accused official and on completion of the exercise recommendations were made for imposing major penalty.
After detailed examination of the case, the Financial Commissioner Revenue found Rakesh Kumar guilty of misconduct. Accordingly, as per the order of FCR, a penalty of withholding three increments with cumulative effect under Rule 30 of J&K Civil Services (Classification, Control and Appeal) Rules has been imposed upon Rakesh Kumar.
