10 yrs RI to accused in minor’s gang-rape

JAMMU, Jan 28: Principal Sessions Judge Udhampur, A K Koul today awarded 10 years rigorous imprisonment and fine of Rs 20,000 each to accused Sanjay Kumar and Jatinder Singh, who committed rape with 8th Class student.
According to police case, on May 25, 2005 prosecutrix after attending games at Udhampur Stadium boarded a vehicle bearing registration number JK14-5711 to reach her native place. However, she was forcibly taken to a secluded place by Sanjay Kumar, driver of the vehicle, and Jatinder Singh after the girl started vomiting.
At the isolated place near Jaganu, the accused raped the prosecutrix for the whole night and in the morning they threatened her that if she dared to narrate the story to any one they would kill her. Though initially the girl didn’t disclose the incident to anybody due to the fear of losing her life at the hands of accused, on June 5, 2005 she narrated the story to her parents, who got a case registered.
After hearing Public Prosecutor Navneet Gupta appearing for the State whereas Advocate Pawan Jandial for the accused, Principal Sessions Judge observed, “there is a devastating increase in crime against woman more particularly in rape cases through the length and breadth of this country. The offence of rape affects the victim both in body and soul. She finds no place to hide her face. She has to face hostile atmosphere even in her home”.
“Rape is worse than homicide. In a case of murder one looses his/her life but in a case of rape victim is robbed of her dignity. It is murder of soul and often rape victim lives with the event till her life. The Courts have to be live to such incidents and ensure that a rapist does not escape adequate punishment which is commensurate to the crime committed by him”, Principal Sessions Judge said.
“The accused in this case are below 30 years of age and keeping in view the nature of crime committed by them, the manner in which it was committed, and all other surrounding factors, I suppose they deserve a punishment which is proportionate to the crime committed by them”, Principal Sessions Judge further said.
With these observations, 10 years Rigorous Imprisonment was awarded to both the accused. Accordingly, their bails were cancelled and directions were issued for taking them to jail to serve the sentence.
