Court restrains Sports Council from holding election of Karate Asso

JAMMU, Aug 3: In a suit filed by Ashwani Kumar Sharma for grant of temporary injunction under Order 39 Rule-1 & 2 CPC, the Sub-Judge (CJM) Jammu has restrained Jammu and Kashmir State Sports Council from holding the election of Amateur Karate-Do Association, which it had scheduled for August 6, 2017.
According to applicant, in pursuance of the decision taken in the Standing Committee Meeting, the Sports Council has issued notification No. SC/ 634/ 2391-99 dated 16.06.2017, thereby fixing the date and venue of Associations in the State and also nominated observers, which is being illegal, un-warranted and not sustainable in the eyes of Law.
The applicant further says that the person nominated by the Sports Council is neither the founder member nor the member of the governing body of the Association as such is not eligible to cast vote as per the rules and regulations of the Association.
The Court has thus temporarily restrained the Sports Council from holding the elections on August 6, 2017, the Order however is subject to the objections by the other side.
