JAMMU, Oct 4: Additional District Judge, Jammu, M S Parihar today restrained M L Nehru from acting as General Secretary of the Jammu and Kashmir Cricket Association and representing Kashmir Cricket Club, Srinagar in any manner.
The order was passed in a suit titled Ravinder Singh and Others Versus Jammu and Kashmir Cricket Association and Others.
Senior Advocate M K Bhardwaj assited by Advocates Ajay Vaid and Ashish Kant Sharma appearing for the plaintiffs submitted, “the plantiffs have instituted a suit for declaration to the effect that the selection of M L Nehru as General Secretary of JKCA made in the election meeting of the working committee of JKCA is illegal and void abinitio, with consequential relief of permanent prohibitory injunction restraining him from performing and taking any decision for the JKCA in his capacity as General Secretary and further restraining him from holding meeting of office bearers on October 5 pursuant to the notice published in a newpaper”.
They also sought direction to the JKCA to hold election for General Secretary according to its constitution and also directions to the defendants—JKCA, Dr Farooq Abdullah, president of JKCA, M L Nehru, General Secretary, G M Bhat, Treasurer and Board of Control of Cricket in India through its General Secretary that till a new General Secretary is elected the Senior Joint Secretary of JKCA shall perform its executive functions with further relief of permanent prohibitory injunction restraining the BCCI from recognizing M L Nehru as General Secretary of JKCA.
After hearing counsels for the plaintiffs, Additional District Judge, M S Parihar said, “the main contention of the plaintiffs is that M L Nehru has been placed under suspension and restrained from acting or representing Kashmir Cricket Club, Srinagar in any manner or capacity as per Letter No.JKCA/K-GS/S/2214-2217 dated March 14, 2011 issued by the then General Secretary of JKCA”.
“The plaintiffs state that M L Nehru presently has no authority to convene any meeting of the JKCA and from the perusal of the material on the file, it appears that the plaintiffs have made out a prima facie case in their favour and in case the ad-interim order is not passed at this stage, they will suffer loss and their suit will become infructuous and there will be multiplicity of litigation also”, the court observed.
Considering the urgent and emergent nature of the case, court issued notice to the defendants for filing objections if any on the next date. In the meanwhile, subject to objections of the other side and till the next date of hearing, M L Nehru is temporarily restrained from acting as General Secretary of JKCA in case his suspension is in operation.
The court has fixed October 16 as next date of hearing.
