Udhampur court rejects bail in murder case

UDHAMPUR, Aug 10: Principal Sessions Judge M L Manhas today rejected bail application of one Sanjay Kumar who is facing trial in a murder case.
Rejecting the bail application, Principal Sessions Judge Udhampur observed that in the present case, there is no dispute that the accused has been charged for the offences punishable under Sections 302 RPC and trial is going on while only less than half of the witnesses have been examined so far.
According to the case history, the accused had allegedly killed the deceased after a quarrel between the two on the intervening night of January 15-16, 2017, when the former with his criminal intention inflicted blows on head of the latter with a wooden club.
After hearing Counsel for accused G R Khajuria and Public Prosecutor inderjeet Sharma, Principal Sessions Judge observed that the prosecution case is based on circumstantial as well as direct evidence and the circumstantial evidence is yet to be adduced. “Out of 24, only 10 witnesses till date have been examined by the prosecution and they have not squarely exonerated the accused/applicant herein. Therefore in view of the given facts and circumstances, the bail application appears to be premature. I do not think accused person deserves discretion of this court at this stage. The offence alleged to have been committed by the accused is heinous and entail punishment of death or life sentence. Unless and until all the important witnesses are examined in the case, this court cannot come to the conclusion,” observed the Judge and rejected the bail plea.
