SRINAGAR, Sept 23: Observing that the Kashmir Chamber of Commerce Industries and its rival party are not interested in holding the elections for the KCCI as they have not responded to the court proposal, High Court has held that the trial judgment with regard to the chamber shall remain in force.
Justice Ali Mohammad Magrey said that while considering the case in hand the court perceived that both the parties (KCCI and opponents) were genuinely interested in conducting the election to the 21 member Executive Committee of KCCI but both the parties demonstrate their dithering and goby attitude with regard to holding of fresh election of the Industry.
“I think it would be distasteful to narrate herein all that what happened and transpired during this period. It would suffice to say that the efforts put in by the court in this regard have failed. That is it”, Justice Magrey said.
Court had asked the KCCI and its opponent party to provide the suitable names of members to enable the court to constitute and nominate the requisite committee for conducting the elections of KCCI.
Justice Magrey said, keeping in view of the prestigious nature of the organization and the stature, honour and the reputation of most of its members in the society, Court thought it would be appropriate and in the interest of the Chamber to propose via-media to the parties to appeal for the conduct of the elections and to bring the litigation to an amicable resolution.
Justice Magrey today in its order said that the court got the impression that the parities have responded positively, but both of them appeared to be prepared to go-by approach the efforts put in by the court both of them demonstrated their dithering attitude.
Court has already heard the matter and has reserved its verdict. Since the proposal of constituting a committee for holding elections has failed, court said it would proceed accordingly to decide the appeal in hand.
