JAMMU, Apr 23: In a contempt petition filed by one Baldev Singh, Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Dhiraj Singh Thakur today directed Director General of Police to pay Rs 40,000 as compensation to the petitioner for delay in implementation of the order within a period of two weeks.
After hearing Senior Advocate S S Lehar for the petitioner, Division Bench observed, “this contempt petition was filed against non-compliance of the order dated 27.12.2011 wherein Division Bench had affirmed the order dated 07.10.2010 made in SWP No.1599/2002”.
“The Writ Court had given directions to the respondents to consider the case of the petitioner for appointment as Follower and the SSP Samba was directed to refer the case of the petitioner to General Administration Department for relaxation of his upper age limit in terms of Rule 5 of Civil Services (Classification Control and Appeal) Rules, 1956 within a period of three months”, the DB said.
“Instead of referring the matter, an appeal was filed which was dismissed by the Division Bench directing the respondents to comply with the directions of Single Judge within a period of two months. Thereafter SLP was filed before the Supreme Court which was also dismissed on 08.04.2013. Even thereafter, no action was taken for about two years”, the DB said.
“There is no explanation for the delay in implementing the order of this court, except by stating that SLP was pending before the Supreme Court which itself was dismissed on 08.04.2013. In such circumstances, willful disobedience of the order of this court is established against DGP”, the DB said, adding “without punishing him, it is ordered that DGP shall pay a sum of Rs 40,000 as compensation to the petitioner for the delay in implementation of the order of this court within a period of two weeks from today”.
