KATHUA, Dec 24: Judicial Magistrate, 1st Class Renu Dogra awarded one year imprisonment and fine to a driver for killing four passengers due to rash and negligent driving.
The accused driver identified as Kuldeep Singh, son of Puran Singh of Dablehar, RS Pura, Jammu was facing trial in case of death of four passengers by rash and negligent driving under Section 279/337/338/304-A RPC.
As per the case, on March 10, 2006 Police Station Kathua received an information that a bus bearing number JK02F-7157 which was driven by Kuldeep Singh, son of Puran Singh of Dablehar, RS Pura in a very rash, careless and negligent manner from Jammu to Kathua at Sahar Khad hit a tractor and rolled down from the bridge, in which four persons were killed.
After completion of investigation challan was presented in the Court of JMIC, Kathua, after hearing SrPO RP Singh appearing for the State and Ld Council for accused, Court observed that the prosecution has proved his case beyond reasonable doubt and evidence of eye-witnesses is also corroborated by medical evidence. The accused is proved to be guilty and liable to be convicted.
The Court awarded simple imprisonment of one year and fine Rs 2000 for the commission of offence under Section 304A RPC. Simple imprisonment for 6 months and fine of Rs 1000 for the commission of offence under Section 338 RPC, simple imprisonment for one month and fine of Rs 500, simple imprisonment for two months and fine of Rs 1000 for commission of offence under Section 279 RPC.
