Nothing illegal in CET exams: HC

Srinagar, Aug 26: Jammu and Kashmir High Court today directed the trial court to finish the criminal challan of the BOPEE scam within six months after the court closed the PIL regarding the case saying nothing illegal was found in the CET examinations of 2009, 2010 and 2011.
The Division Bench of Chief Justice N P Vasanthakumar and Justice Hasnain Masoodi after perusal of report filed by Crime Branch said that the investigation conducted in respect of three CET exams is satisfied. “We are satisfied with the investigation conducted based on which closure report was filed in respect of CET examinations conducted for the years 2009, 2010 and 2011”, the bench ordered while closing the entire PIL.
With regard to CET 2012 in which huge bungling and selling of papers in league and connivance with ex BOPEE chairman, Mushtaq Peer, were un earthed court said the case has been registered about the exam and matter is being tried by court of Special Judge Anticorruption, Srinagar, Kashmir.
Court further added that when the bail application filed by prime accused (Mushtaq Peer)  was rejected on merits on August 2015, Anticorruption Court on that day was directed to complete the trial in  the challan within a period of six months and report the registry.
“A direction to the learned Special Judge Anticorruption Kashmir, Srinagar to dispose off the  criminal challan on day to day basis within a period of six months and report was directed to be filed by the registry by the said court after concluding the trial in accordance with law by the end of February 2016”, read the order.
Inspector General of Police Crime Branch in his status report explained the manner in which the investigation was conducted and the closure of investigation. “In so far as the examination conducted for selection for the years 2009, 2010 and 2011 are concerned after thorough investigation no malpractice could be noticed by the investigating agency (CB)”, observed the court after going through the status report.
About the investigation of CET 2012, it was found that the question papers as well as the key answers sold before conducting the examination and criminal challan against 51 accused was presented before the court of law.
The probe was initiated on the basis of a letter written by one of the Judges to the Chief Justice pointing out therein the cancellation of Physics and Mathematics papers of CET on account of leakage of question papers due to the fault committed by the persons responsible for conducting the said examinations.
Thereafter, court enlarged the scope of the PIL regarding the conduct of CET examinations conducted to select the candidates for MBBS and other professional courses for earlier academic years.
