JAMMU, Aug 20: High Court today held that mere pending of civil litigation is not a ground to quash FIR.
The observation was made in a petition filed by Razwan Qazi and others seeking quashment of the FIR No. 224/2016 dated 27.10.2016 registered with Police Station Bahu Fort (Trikuta Nagar) for commission of offences under Section 447, 427, 379 RPC.
The genesis of the dispute between the parties is a plot of land measuring 01 kanal 14 marlas falling under Khasra No. 227 min situate at Sunjwan.
After hearing Advocate Ajaz Choudhary for the petitioners whereas AAG Aseem Sawhney for the UT, Justice Dhiraj Singh Thakur dismissed the petition with the observations that merely because a civil litigation is pending between the parties would not necessarily result in quashing the FIR in question, which is at the very initial stage of investigation.
