Life imprisonment for Pak ultra

POONCH, Oct 30: Principal Sessions Judge, Poonch, Kishore Kumar has awarded life imprisonment to a Pakistani national for his involvement in murder and attempt to murder cases.
Identified as Mohd Nayeem Anwar alias Shahzad alias Asaf Safadar alias Abu Maz, son of Mohd Anawar Bhat, resident of Lahore in Pakistan, the Pak-militant was involved in killing of a J&K Police personnel Rajesh Kumar and causing injuries to the two other cops at Mohalla Pathana in Poonch on July 11, 2003. Prosecution has proved the case beyond all reasonable doubts.
The accused was facing trial for the commission of offence under Sections 302/307 RPC and 7/25, 26, 27 Indian Arms Act, since 2003. In charge Commando Group Mendhar, on the inputs of the presence of the Pakistani trained militants from different centers have entered the territory of district Poonch, with a motive to strike the vital parts of the State and create law and order problem by disturbing peace and resorting to killings of innocents.
During search operation in the forest near Pathana Mohalla, the militants opened firing on the police party. The patrolling party also retaliated. In this encounter, Constable Rakesh Kumar was killed while three Policemen Muzaffar Hussain, Mohd Saif and Suran Singh and two civilians – Imtiaz Ahmed and Azad Khan were injured.
After hearing Public Prosecutor Nazir Ahmed and advocate Anuj Kapoor for the accused, the court observed that the prosecution has succeeded in proving the case against the accused beyond all reasonable doubts. The court awarded life imprisonment for commission of offence under Section 302 RPC alongwith a fine of Rs 20,000 and five years and fine of Rs 5000 for the commission of offence under section 307 RPC and 7 years along with fine of Rs 10,000 in proof of offence under Sections 7/25,26,27 Arms Act. The court however rejected the plea of death penalty as the case does fall in the category of rarest of the rare case.
