JAMMU, May 15: Principal Sessions Judge Jammu, R S Jain today acquitted alleged HM militant namely Majid Hussain, son of Ghulam Hussain Mughal of Gandoh, who was facing trial in 3/ EAO, 3/12 Passport Act and 2/3 EIMCO, as prosecution witnesses didn’t support the police case.
After hearing counsels for both the sides, Principal Sessions Judge observed, “it is a settled principle of law that prosecution is under an obligation to prove the guilt of accused by cogent clear evidence”, adding “in the present case, there is not an iota of evidence adduced by the prosecution to connect the accused with the commission of offence with which he is charged”.
With these observations, Court acquitted accused Majid Hussain of the charges leveled against him.
