HC takes cognizance of Excelsior story on COVID testing

Srinagar, June 4: High Court while taking suo-moto cognizance of news report published in Daily Excelsior with regard to time gap between taking Corona samples and their results today issued notice to Health & Medical Education Department to inform the court the mode of collection of samples and the result.
A report carried on 25th May 2020 in the ‘Daily Excelsior’ has been registered as a Public Interest Litigation and placed before the Division Bench of Chief justice Gita Mittal and Justice Rajnesh Oswal for hearing.
The DB after perusal of the news report which discloses a time gap between the taking of samples for COVID-19 infections and the receipt of the test reports sought details from H&ME Department on the issue.
Giving reference of some of the security personnel who were tested and found positive during discharge of public functions, the time gap of collection of their samples and results as shown takes a lot of time.
Court has referred the instance of a police constable of the 19th Battalion of the Indian Reserve Police who was on duty at Lakhanpur in Kathua District, a BSF constable and an Army jawan.
Court before proceeding in the matter, issued notice to the Secretary, Health and Medical Education Department, UT of Jammu and Kashmir to place on record, in a tabulation, the manner in which samples for COVID-19 testing are being collected, the manner and the time taken for transporting them to the laboratories for testing and the schedule on which test reports are obtained.
“Let a report in this regard be placed in this court before the next date of hearing”, the DB directed
Advocate Monika Kohli has been appointed as Amicus Curiae in the matter in order to assist the Court on June 10.
