JAMMU, July 7: In a petition filed by one Major Singh Incharge Naib Tehsildar who was transfered four times in a year challenged his premature transfer from Kashtigarh to Gundna, Justice Tashi Rabstan of J&K High Court Jammu Wing after hearing Adv Veenu Gupta appearing for the petitioner issued notice to the respondents and ordered that subject to objections from the other side and till next date of hearing before the Bench, the order impugned dated 3. 7.2015 shall not be acted upon.
During the course of arguments, Adv Veenu Gupta submitted before the Court that the petitioner was appointed as Naib Tehsildar in the year 2009 and after rendering about five years service as such was placed as Incharge Tehsildar vide Government order No. Rev/Gaz/183 of 2014 dated 24.7.2014. Consequent upon his placement as Incharge Tehsildar, the respondent vide Government order No. Rev/Gaz/191 of 2014 dated 04.8.2014, amongst others, directed the petitioner to look after the work of Tehsildar Kashtigarh District Doda and the respondent again issued Government order No. Rev/Gaz/261 of 2014 dated 29.10.2014 whereby the petitioner was prematurely transferred and posted as Incharge Tehsildar Rajgarh in District Ramban. She further submitted that again respondent vide Government order No.80/Rev/GAZ of 2015 dated 24.04.2015 prematurely transferred the petitioner and posted him in Kashtigarh Doda as Incharge Tehsildar. Vide this Government order, the private respodent was transferred and posted as Tehsildar Gundna District Doda.
Counsel for the petitioner further submitted that the petitioner was again transferred vide order No.104-Reve(Gaz) of 2015 dated 03.07.2015 whereby amongst others, the petitioner and the private respondent has been directed to swap their place of posting. The petitioner at the time of issuance of the impugned Government order is working as Incharge Tehsildar Kashtigarh, Doda whereas the private respodent is working as Incharge Tehsildar Gundna and seeking quashment of the same.
