Srinagar, Nov 1: The High Court today sought response from the State and Union Governments within three weeks for compensation to next of kin of those who have died in prison due to unnatural death.
The Division Bench of Justice Mohammad Yaqoob Mir and Justice Ali Mohammad Magrey sought response from Principal Secretary to Home J&K, DG Prisons, J&K, DGP J&K and Union of India through Ministry of Home Affairs, Government of India within three weeks.
The directions of Supreme Court have been taken up suo moto passed in a case captioned as “Inhuman conditions in 1382 prisons”.
Supreme Court directed the Secretary General of court to transmit a copy of decision to the Registrar General of every High Court within one week with a request to the Registrar General to place it before the Chief Justice.
Supreme Court with a request the Chief Justice directed to register a suo motu public interest petition with a view to identifying the next of kin of the prisoners who have admittedly died an unnatural death as revealed by the NCRB during the period between 2012 and 2015 and even thereafter.
It has also been directed that award of suitable compensation be provided to next kin of these prisoners, unless adequate compensation has already been awarded.
The suggestion for identifying and compensation to kin of prisoners was put forward by the amicus and the counsel appearing for National Forum has been accepted by the Supreme Court, consequently directions were passed to CJ of every High Court.
High Court earlier had sought details of those kin as indicated in Supreme Court order which related to the State of J&K.
