SRINAGAR, Apr 5: Jammu and Kashmir High Court today sought personal appearance of Station House Officer (SHO) Kupwara in a case for ascertaining the real and actual antecedents of a foreigner who is in jail.
Justice MH Attar directed SHO Police Station Kupwara to remain present before the court along with case dairy pertaining to the case on next date of hearing so that the native place of the detenue can be ascertained.
The detenue, Noor-Ul-Haq, who claims to be the native of Kingdom of Saudi Arabia is presently lodged in Central Jail Srinagar but according to counsel appearing for Union of India, the Royal Embassy of Kingdom of Saudi Arabia in New Delhi has denied that the detenue is Saudi national.
Counsel appearing for the detenue submitted at bar that the detenue is insisting on being a Saudi national. He further submitted that when Haq was arrested by Police all his documents including his passport issued by his native country viz Kingdom of Saudi Arabia was seized by police personnel.
Court after these submissions said that the detenue cannot be kept in State custody for an indefinite period as his basic human right of liberty and freedom is infringed. “In order to find out the way to his piquant situation it is deemed to direct SHO to remain present in the court on next date of hearing”, reads the order.
Court further directed the Principal District and Sessions Judge Kupwara to provide information after scrutinizing the records as to what were the documents seized during the investigation of the case and send those documents along with challan of detenue to the Registrar Judicial of the court by next date of hearing.
Court also directed Registrar of the Kashmir University to depute a professor or lecturer from Arabic Department of the university to Central Jail for interaction with the detenue and shall enquire specifically from him about his native place for any proof.
