HC seeks appearance of CE PDD

SRINAGAR, Oct 17: The State High Court has directed the Chief Engineer, Power Development Department M&RE wing Kashmir to remain present before the court for not implementing the court orders in its right perspective.
Chief Justice N Paul Vasanthakumar today came down heavily on CE PDD for not implementing the court orders in tune with the court directions and sought his personal appearance on next date of hearing.
Court was hearing third round of litigation filed by the petitioner Mohammad Akbar Mir against the Power Development Department for not implementing the basic judgment of 2006 its right perspective.
“In such circumstances, the present CE PDD M&RE wing Kashmir is directed to appear in person on 20.10.16 before this court along with the compliance order”, CJ directed.
Court also made it clear that if the compliance order of basic judgment is not passed by next date then the court may impose 9 percent interest to the amount payable to the petitioner.
Court also warned CE PDD that if the compliance order is not passed then he will not be permitted to draw his salary till the order of this court is complied with.
Petitioner’s basic petition was allowed in the year 2006 with the direction to the respondent department to release the grade of Installation Inspector in favour of the petitioner-Mir from the date the job was assigned to him with a period of three months.
CE while complying the judgment of the court has partially implemented the court judgment which compelled the petitioner to approach this court again and the court directed for implementation of judgment in its entirety within eight weeks time.
While complying the court direction, CE modified its earlier order (on 9.4.2012) to the effect that the benefit and designation already accorded in favour of the petitioner is retrospectively protected with effect from March 1993 instead of 2006 but without involvement of any monitory benefit or drawal of any arrears on this score.
“The order dated 9.4.2012 passed by the CE is also not in tune with the order of writ court which specifically granted relief to the petitioner to get the grade pay from the date of the job of Installation Inspector was assigned to him”, read the order in which personal appearance of CE has been sought.
