JAMMU, Feb 17: High Court has quashed the abetment to suicide FIR registered against Yashpaul Singh, Sarpanch of Panchayat Halqa Ratnuchak registered at Police Station Purmandal.
While challenging the FIR, Advocate Meenakshi Slathia appearing for the petitioner-Sarpanch vehemently argued that there is no allegation in the FIR against the petitioner but despite the FIR has been registered against him.
“The petitioner has been arrayed as an accused only because of the reason that he intervened and tried to reconcile the matrimonial dispute between deceased and respondent being the Sarpanch and resident of the same village”, the counsel for the petitioner said.
After hearing all sides, Justice Rajnesh Oswal observed, “an FIR can be registered for commission of offence under Section 306 RPC only when there are allegations those fall within the meaning of Section 107 RPC resulting into suicide by the other”.
Quoting some judgments of Supreme Court, High Court further observed, “so far as instant FIR is concerned, there is no material on record to justify continuance of investigation so far as petitioner is concerned. The case of the petitioner squarely falls within the law laid down by the Apex Court”.
Accordingly, High Court quashed the FIR No.11 of 2013 dated October 22, 2013 registered with Police Station Purmandal for commission of offence under Section 306 RPC qua the petitioner only.
