HC for facilities in orphanages

SRINAGAR, Oct 12: The High Court today directed the Social Welfare Department to remove all deficiencies in observation homes and orphanages immediately.
Amicus Curie to the PIL Senior Advocate B A Bashir informed the Court that the report of the department with regard to facilities available in observation homes are not adequate and do not meet with the prescribed rules.
The division bench of Chief Justice Badar Durrez Ahmad and Justice Ali Mohammad Magrey directed the authorities to remove the deficiencies immediately and in-fact these deficiencies viz-a-viz rules (Juvenile Justice (protection & care of children) Act and its rules should be removed and report the court on next date.
Court also directed the counsel representing Youth Services and Sports to report the court about providing of all sports facilities to the orphanage and observation homes situated at Shalimar and Harwan in Srinagar.
Advocate Bashir, meantime, visited an observation home and submitted his report to the court and point out various deficiencies in his visiting report. Court directed the Mission Director to remove these deficiencies immediately.
Advocate Bashir in terms of previous directions has submitted his suggestions for improving the conditions in observation homes and orphanages in the State, which the court has taken on record and directed the State to file response to these suggestions.
He also sought time to response the points of action as mentioned in the affidavit of Commissioner/Secretary SWD.
Court on last date had directed to specify the requirements envisaged in Juvenile Justice Act for orphanages and directed for filing of fresh affidavit indicating there-in the plan of action to meet all deficiencies.
Commissioner/Secretary was directed to file his affidavit by next date indicating there-in the action of plan to meet the deficiencies in orphanage homes across the State.
