HC directs closure of unregistered coaching centres

Srinagar, June 11: High Court today directed both Divisional Commissioners of Kashmir and Jammu divisions to ensure that the unregistered coaching centers across State are not functioning against the Tuition Center Rules of 2010 and inform the court whether all unregistered coaching centers have been closed or not.
The Division Bench of High Court comprising Justice MH Attar and Justice B S Walia in a PIL directed that court orders passed from time to time and Government order is implemented in letter and spirit.
“The Divisional Commissioner Jammu shall ensure that the court orders passed from time to time and Government order is implemented throughout length and breadth of Jammu Division. The Divisional Commissioner Kashmir shall ensure that none of the unregistered coaching centers is allowed to function in the Kashmir Division. He shall provide the list of unregistered coaching centers of the Kashmir Division and also inform, whether all of them have been closed or not”, court directed.
Court also directed that pupil-teacher ratio in the coaching centers shall be maintained as the coaching centers have adversely affected the teaching standard.
“The State Government with the assistance of the experts shall form norms for fixing pupil-teacher ratio and issue appropriate order for its implementation”, court directed.
Court in this regard sought compliance report from Commissioner Secretary to Education Department, and Divisional Commissioners of Kashmir and Jammu before next date of hearing.
Court has been apprised by Divisional Commissioner Kashmir through compliance report that a meeting on May 13 was convened under his chairmanship for implementing the court orders as also the Government order occupying the field.
Divisional Commissioner Jammu also submitted before the court that orders are being implemented by the committee formed for this purpose headed by him. He also states in his report that one of the coaching centers namely Symbiosis Study Circle Shastri Nagar was approved for registration after proper inspection by DC Jammu.
It has also been submitted before the bench that all the DCs have been directed to inspect the coaching centers along with CEOs and submit their inspection report so that appropriate recommendations are made for their registration to the Director School Education Jammu.
Advocate Sunil Sethi who is appearing for coaching centers of Jammu submitted before the court that one coaching center ASL Academics Jammu has completed all formalities required for registration and sought direction be issued to Div Com to accord consideration to the claim of the coaching center.
Court also directed that those coaching centers who have obtained registration from the concerned authorities shall be allowed to operate their bank accounts and Div Com shall furnish their list (registered coaching centers) to the concerned bank authorities.
