JAMMU, Oct 21: Delhi High Court today granted a major relief to Power Development Department of J&K by staying the order passed by the Central Electricity Regulatory Commission directing the Secretary Power Development Department to pay the Unscheduled Interchange charges of Rs 75 crore by 25th of this month failing which the Commission had warned that contempt proceedings will be initiated against the Secretary Power Development Department.
The State, through its standing counsel Suhail Malik challenged the order in Delhi High Court on the grounds that the Central Electricity Regulatory Commission has failed to adhere to the principle of natural justice and that the order was bad in the eyes of law as the Central Electricity Regulatory Act 2003 does not extend to the State of Jammu and Kashmir as per the Article 370 of the Constitution of India.
The court after hearing the submissions of the standing counsel Suhail Malik stayed the order of Central Electricity Regulatory Commission.
