JAMMU, Nov 5:
The Delhi High Court has directed the surrender of Sudershan Singh Wazir, in connection with he murder of former National Conference MLC Trilochan Singh Wazir in September 2021.
Wazir, 67 was found dead with a gunshot wound in a flat in Delhi in September 2021.
In 2023, Sudershan Wazir was among three people arrested by the Delhi Police in connection with the case. He was discharged for murder and other offences, along with three other accused, in the case by the Tis Hazari court on October 20 of the same year.
The next day, the Delhi HC had stayed the district court’s verdict. While three other accused who were discharged by the district court — Harpreet Singh Khalsa, Rajender Chaudhary and Balbir Singh — were still in judicial custody at the time when the district court’s verdict was stayed, Sudershan had already been released on the night of October 20, 2023.
The latest direction came in an application filed by the Delhi Government under CrPC Section 390, which deals with the arrest of the accused in an appeal from acquittal, seeking the court’s directions for Sudershan’s surrender.
Directing Sudershan’s surrender, the court of Justice Anish Dayal reasoned, “In the opinion of this court, there can never be a situation where the court, in its discretion, would not take steps to rectify this situation and would not correct it, to ensure that, in effect, its orders are both judicially and practically implemented… It is quite clear that by staying the operation of the impugned order, the court intended to ensure that consequential action under the discharge order is not taken.
