PIL against encroachments in old city

JAMMU, July 29: In a Public Interest Litigation (PIL) highlighting illegal encroachments in old Jammu city, Division Bench of State High Court comprising Justice Dhiraj Singh Thakur and Justice Sindhu Sharma has directed the Jammu Municipal Corporation to file detailed report.
During the course of hearing, Advocate Ajay Sharma appearing for the PIL pointed out that area in front of Jambulochan Hall and the park adjacent to it has been encroached by the hawkers leaving no space for the pedestrians to walk freely.
He further submitted that recently a shop was opened in the area which is causing huge traffic chaos on account of illegal parking of the vehicles. “The Municipal Corporation ought not to have permitted any such activity considering the fact that this road is one of the main road which links the old city with the Janipur area, Kachi Chawni, Mubarak Mandi”, he added.
It was further submitted that Municipal Corporation has permitted the construction of four storey commercial complex on the Manda-Amphalla road despite the fact that the complex has no parking space.
Upon this, DB directed Commissioner JMC to furnish details of whether the Municipal Corporation or the authority under the Food Safety and Standards Authority of India (FSSAI) has permitted the food-joints to run their establishments from the foot-path.
During the course of hearing, it was submitted that the residents of Ustad Mohalla and adjoining areas of Karan Nagar who do not have any parking space are forced to park their vehicles on the roadside and bye-lanes thereby choking the access to the residential colonies.
It was suggested that the Municipal Corporation could acquire the land for purposes of raising multi-storey parking complex, which can be beneficial for the public and this would considerably reduce the parking problems of area. Accordingly, DB directed JMC to file detailed report on this aspect.
