JAMMU, Feb 24: In a Public Interest Litigation filed by Advocate Ravi Abrol seeking directions to respondents to upgrade the Civil Airport, Jammu at par with the international airports, a Division Bench of Jammu & Kashmir and Ladakh High Court comprising Justice Tashi Rabstan and Justice Moksha Khajuria Kazmi issued certain directions to the concerned authorities.
Advocate Ravi Abrol appearing for the PIL stated that revenue authorities have not handed over the possession of land in terms of award dated 30.01.2008. On this, DB said, “though the Deputy Commissioner, Jammu is not a party in the instant PIL, but being the Collector, the Deputy Commissioner, Jammu is the authority to implement the award dated 30.01.2008”.
Accordingly, DB directed Senior AAG Monika Kohli appearing for the Deputy Commissioner, Jammu, to file an affidavit stating therein how much time is required for handing over the land in question in terms of the award dated 30.01.2008 by or before the next date of hearing.
DB further directed Advocate Inderjeet Gupta and Advocate Yatin Mahajan appearing for the Airport Authority of India to file compliance with regard to the action taken on the direction dated 29.03.2019 whereby Division Bench observed that Ministry of Defence has issued a communication dated January, 2019, informing that airfield watch hours at Jammu stand extended up to 2100 hrs from Monday to Saturday by the Air Headquarters.
The Civil Aviation Department of the UT has sought intervention of the Ministry of the Civil Aviation to impress upon the commercial airlines from starting the early morning and late evening flights, by or before the next date of hearing.
