SRINAGAR, July 25: The High Court today directed the Law, Justice and Parliamentary Affairs department to complete the proposal of High Court with regard to creation of posts for e-court without any delay.
The direction has been passed after the counsel representing High Court submitted before the division bench of Chief Justice Badar Durez Ahmad and Justice Ali Mohammad Magrey that proposals for creation of various posts has been sent to LJ&PA department by the Registrar General of High Court with a request that the proposals which are pending consideration to see the light of the day at the earliest.
“These proposals shall be completed immediately without any further delay. Law department shall not wait for further proposals”, DB said. Court has been informed that the new district court complex at Moomin-Abad, Batmaloo is complete in all respects. “The said complex shall be inaugurated on July 29”, CJ said.
Court has also been informed about the construction work at district court Bandipora and State counsel in this connection submitted before the court that negotiations have been done with those whose land has been acquired and court will be apprised about the handing and taking over of acquired land by next date.
Court has been apprised about the issue of daily wagers of judiciary and some misunderstanding and communication gap has arisen as such time has been sought from Finance Department for filing of fresh status report on the issue of daily wagers.
It may be mentioned here that court on yesterday took serious note to the response of Finance Department filed with regard to the said issue and directed the Secretary Finance to be present before the court.
Court said that in so far as the issue of daily wagers is concerned, some misunderstanding has taken place about the order of the court as such court directed that fresh communication be issued by the law department along with court orders which is to be forwarded to Finance Department for further action.
Court has already warned that in case the issue is not addressed then court will issue ‘Mandamus’ to the Government.
It may be mentioned here that the Supreme Court while deciding the matter had observed “It is unfortunate in our view, that State Government has allowed the requirements of the state judiciary to be neglected over such a long period of time and the need to facilitate the proper functioning of the High Court and the district judiciary is a constitutional necessity which imposes a non-negotiable obligation on the state government to create an adequate number of posts and to provide sufficient infrastructure.”
Supreme Court, in its judgment, has held responsible the State Government for creating situation of recruiting persons on daily wage basis on large scale and has blamed the Government for the ‘unfortunate situation’ which has resulted in a large number of persons being recruited on a daily wage basis.
