Court grants bail in attempt to murder case

JAMMU, Oct 5: Judicial Magistrate Ist Class, Jammu, Pravin Pandoh today granted interim bail to two accused, who were involved in attempt to murder case.
According to the police case, the accused persons namely Baber Khan, son of Ghulam Nabi of Bhawani Nagar, Talab Tillo and Supreet Singh, son of Davinder Singh of Mohalla Dalpatian had on August 20 fired upon one Ranjeet Singh near Bikram Chowk after intercepting his auto-rickshaw.
When the bail application of the accused persons came up for hearing, the prosecution objected the same on the grounds that the offence committed by the accused persons was non-bailable in nature and accused cannot claim bail as a matter of right.
After hearing Advocate Monika Kohli appearing for the accused/applicants and Senior Prosecuting Officer for the State, Judicial Magistrate Ist Class observed, “perusal of CD file reveals that the investigation of the case is complete so far as accused persons are concerned. Even the statements of the witnesses have been recorded”.
“Law is well settled that bail is the rule and jail in exception. In the circumstances of the case this court is of the opinion that discretion available under Section 497 CrPC may be exercised”, Judicial Magistrate said.
Accordingly, the court released applicants on interim bail up to October 12 on furnishing bail bonds to the tune of Rs 20000 each and personal bonds to the like amount. The court, however, directed the applicants to cooperate with the investigating agency and they shall not hamper/tamper with the prosecution evidence in any manner.
“In case of breach of any of the conditions, the prosecution shall be at liberty to seek cancellation of bail”, the court said.
