Court denies bail to narco smuggler

JAMMU, May 15: District and Sessions Judge Kargil, Tahir Khurshid Raina today rejected the bail application of a narcotics smuggler.
According to the police case, the narcotics smuggler namely Ramesh Kumar, son of Dil Bahadur of Nepal and presently putting up at Kabadi Nalla, Kargil was arrested after police recovered 205 grams of charas along with bottles of illicit liquor of different brands from his shop.
After hearing the counsel for the accused and Public Prosecutor Kachoo Manzoor Ali Khan, Sessions Judge Tahir Khurshid Raina observed, “it should not be forgotten that in murder case the accused commits the murder of one or two persons while those persons who are dealing in charas, ganja or other intoxicants, are causing the death of number of persons in the society or ruining their lives”.
“They are hazard to the society and if they are released on bail, they are likely to continue their nefarious activity”, he further said, adding “the liberty of a citizen has got to be balanced with the interest of the society. In cases where narcotic drugs and psychotropic substances are involved, the accused would indulge in activities which are lethal to the society”.
He further observed, “the courts of the country are under the bounden and legal duty to give a strong message to the society particularly when such issues come before it”, adding “Article 19 and 21 as projectyed by the counsel for the applicant are though sacrosanct rights and need to be protected but not at the cost of peaceful atmosphere and rights of the society”.
With these observations, the Court rejected the bail application of the accused.
