CIC reprimands RTI activist for giving wrong facts

JAMMU, Feb 13:  Dismissing a second appeal against FAA and PIO of Revenue Department, the Chief Information Commissioner G R Sofi has reprimanded an RTI activist to refrain from giving wrong facts before the Commission.
The RTI activist, namely Madan Mohan Sharma, had filed an application before PIO, Revenue Department, Civil Secretariat, Srinagar. As the information did not pertain to the Revenue Authority, the PIO  forwarded  the RTI  application  to PIO of Deputy Commissioner, Jammu under  Section 6(3) of the  J&K  State  RTI  Act  with  a  copy to the information seeker. However, inspite of being informed, the appellant preferred first appeal before FAA, Revenue Department. He was duly informed by the PIO that FAA in this case was Deputy Commissioner, Jammu. Again he preferred second appeal before the Commission against the Revenue Department, Civil Secretariat, Jammu with the ground of appeal that his RTI application and first appeal were not responded.
Observing that the appeal is wrong and incorrect, the CEC dismissed the same.
“The appellant who regularly pursues RTI is a retired paramilitary officer and well versed with the State RTI Act. He is advised to refrain from giving wrong facts before the Commission which is a quasi-judicial tribunal. The appeal against FAA and PIO of Revenue Department is not maintainable as the information was not with PIO,” the CEC said.
