Bail denied in attempt to murder case

JAMMU, Sept 29: Chief Judicial Magistrate (CJM) Samba Ajay Kumar Gupta has denied bail to one Anil Kumar alias Neetu, son of Tersem Chand of Balater Samba, who has been booked in an attempt to murder case.
The applicant along with two other accused namely Tersem Lal and Ajay Kumar had committed offences under Sections 307, 341, 323/34 IPC by attacking one Ramesh Kumar, who along with his son was returning home from Sumb on September 10, 2020.
The victim is undergoing treatment at Government Medical College Jammu and is fighting for the life. While Anil Kumar was arrested by the police, Tersem Lal and Ajay Kumar are still absconding.
After hearing counsel appearing for accused Anil Kumar and Additional Public Prosecutor, the CJM observed, “the accused is involved in a serious and heinous offence and the investigation is yet to be completed”, adding “prima-facie involvement of the accused in the case has been made out and the victim is still struggling with his life and his statement is yet to be recorded”.
“Further there is every apprehension that the accused will tamper the evidence if released on bail. Such type of accused is not entitled to the discretionary jurisdiction of the court for granting the bail”, the CJM said while rejecting the bail application.
