JAMMU, July 24: Principal Sessions Judge Kathua, M K Hanjura today acquitted two accused namely Surinder Mohan, son of Ram Lal and Jodhamal, son of Dewan Chand, both the residents of Hoshiarpur, who were facing trial under NDPS Act as prosecution miserably failed to prove its case. However, the Court issued General Arrest Warrants against Amarjeet Kour, wife of Avtar Singh of Hoshiarpur, who was declared as absconder.
According to the police case, on October 31, 2006 a police patrol party of Police Station Lakhanpur intercepted a car bearing registration No CH03A/9512 and subjected it to checking. From the vehicle, police recovered three bags containing 17 packets of poppy straw packed in small polythene bags.
After hearing Advocate Ganga Ram for the accused persons whereas Public Prosecutor Ravi Kumar Gupta for the State, Principal Sessions Judge observed, “what can be deduced from the prosecution evidence is that the independent witnesses were available at the place of occurrence but no attempt has been made to examine them. By withholding these independent witnesses and not co-opting them in the investigation of the case, the structure of the prosecution side becomes vulnerable”.
With these observations, Court acquitted two accused and issued General Arrest Warrants against third.
