J&K Govt issues notification for reservation to IB villagers

508 villages declared as ‘Areas adjoining IB’

JAMMU, July 17: The Government of Jammu and Kashmir today issued much awaited formal notification providing reservation to the persons residing in the areas adjoining the International Border (IB) in direct recruitment, professional institutions and post graduate courses.

As per the notification, issued by the Social Welfare Department, Government of J&K, 508 villages situated within the distance of 0-6 kms from IB in Kathua, Samba and Jammu districts have been declared as “Areas adjoining the International Border”, which are eligible for the reservation benefits.
These include 293 villages of Jammu , 142 of Samba and 73 of Kathua district, comprising a population of lakhs of people, who shall be benefitted of the reservation.
In exercise of powers conferred by section 23 of the Jammu and Kashmir Reservation Act 2004, the Government has amended the Jammu and Kashmir Reservation Rules, 2005 by substituting the words “an area near the Line of Actual Control, appearing in coloumn 2 of row 6 of the table in FORM III, with the words and sign “an area near the Line of Actual control/International Border” and adding Clause (iv) “Residents of Area adjoining International Border” after Clause (iii) of the FORM X.
The Government notification, issued vide number SW/BW/01/2015, dated 17-07-2020 has come following the UT administration declared filling up of over 10,000 posts, including 8575 posts of Class -IV category and 1889 of Panchyat Accounts Assistants in the Rural Development Department, thus providing a big opportunity to the unemployed educated youth living in the area adjoining IB.
Pertinent to mention that the Union Government had accorded benefits of reservation to the people living along the IB on the analogy of those living along ALC, making amendment in the Jammu and Kashmir Reservation Act , 2004. The amendment came into force from Ist of March 2019 and the Union Ministry of Law and Justice had notified the same in the Gazette of India on July 9, 2019 as ‘Jammu and Kashmir Reservation (Amendment Act) Act 2019’.
Thereafter, in exercise of powers conferred by Section 23 of Jammu and Kashmir Reservation Act, 2004, the Government vide Notification SRO-518, dated September 2, 2019 made amendments in Jammu and Kashmir Reservation Rules, 2005, which inter alia provided for reservation to the persons residing in the areas adjoining the IB in direct recruitment, professional institutions and post graduate courses, in terms of rule-4, rule 13 and rule 15, respectively, besides authorizing the Government to declare areas as Areas adjoining International Border in terms of section 2(iiia) of the said rules.
State Commission for Backward Classes , vide letter number BCC/IB/2018/901-03, dated 20-09-2018 and SC/BCC/209/202 dated 01-10-2019, had also recommended that the residents of villages falling within the area of 0-6 kms from International Border may be allowed the benefits of reservation under Jammu and Kashmir Reservation Rules 2005.
Earlier, the Social Welfare Department, vide letter No. SW/BW/01-2015, dated 22-01-2019 had requested the Divisional Commissioner Jammu/Kashmir to provide the details of villages situated within a distance of 0-6 kms from the International Border.
Thereafter, the Divisional Commissioner Jammu, vide letter No. 301/893/reserve/IB/2111-16 dated 25-01-2019 provided the list of 508 villages in the Districts of Jammu, Samba and Kathua, which are situated within distance of 0-6 kms from International Border.
293 villages declared as “Areas adjoining IB”, in Jammu district, fall under Patwar Halqa Lehrian, Akhnoor Khas, Chak Kripalpur, Muthi Maira, Devipur, Bakore, Pargwal, Sarwal, Bhalwal Malu, Gurha Manhansa, Kana Chak, Panjore, Kalyanpur, Marh, Gajnasoo, Gango Chak,Gho Manhasa, Rathua, Saharan, Thub, Chinore, Dhaterial, Makwal, Saidharth, Rahal Klandrian, Jabowal, Allal, Pindi Charkan, Kalan, Bhadur Pur, Chak Majra, Arnia, Kathar, Changia, Trewa, Kool Kalan, Chak Majra, Kool Kalan, Samka, Fatehpur Brahmana, Jasore, Badyal Brahmana, Chak Agra, Kalyana, Chakroi, Abdal, Sai Kalan, Charana, Suchetgarh, Chal Mula, Baspur, Rangpur, Nikowal, Jajowal, Chandu Chak, Satowali, Parlah and Chak Mula-2.
Similarly, 142 villages of Rajpura, Ghagwal, Samba, Ramgarh and Vijaypur tehsils of Samba district have been declared as “Areas adjoining IB while 39 villages of Hiranagar and 34 of Marheen tehsil in Kathua district have been declared as “Areas adjoining IB”.
Distances of these villages from Zero Line ranges from 0.2 to six kms.
