20 Principal Distt & Sessions Judges fail to act on CJ’s latest directives

Only 2 Judges start sending daily work done statements

JAMMU, Oct 18: Twenty Principal District and Sessions Judges have failed to act on the latest directives of the Chief Justice of J&K High Court Justice Gita Mittal regarding submission of daily work done statements and Registrar General has made it clear to them that further non-compliance will be viewed very seriously.
The Registrar General of the State High Court Sanjay Dhar vide Communication No.40543-78/GS dated October 11, 2018 had conveyed to all Principal District and Sessions Judges the latest directions of the Chief Justice whereby they were asked to obtain daily work done statements of the courts subordinate to them and furnish the same to the Registrar Vigilance.
The Registrar Vigilance was supposed to place these statements before the concerned Administrative Judge for evaluation and consideration.
It was specifically mentioned in the communication that Principal District and Sessions Judges shall take follow-up action and circulate these instructions amongst all the Judicial Officers working under their jurisdiction for strict adherence.
However, majority of the Principal District and Sessions Judges have yet not started showing strict compliance to the directives of the Chief Justice. This can be gauged from the latest communication of the Registrar General, the copy of which is available with EXCELSIOR.
While drawing the attention of all the Principal District and Sessions Judges towards the Letter No.40543-78/GS dated October 11, 2018, the Registrar General said, “excepting for Principal District and Sessions Judges of Jammu and Srinagar, no other Principal District and Sessions Judge is sending the requisite daily work done statement, which is in clear breach of the directions of the Chief Justice”.
“You are, therefore, once again requested to comply with the directions of the Chief Justice contained in the Letter No.40543-78/GS of October 11, 2018 failing which the matter shall be placed before the Chief Justice”, read the Letter No.41575-108/GS dated October 17, 2018.
Vide communication dated October 11, 2018, the Registrar General had also conveyed the directives of the Chief Justice regarding physical verification of the cases pending in their respective courts where after the Principal District & Sessions Judges shall furnish a consolidated statement of his district in this regard. “The detailed information in this regard is also awaited from majority of the Principal District and Sessions Judges”, sources in judiciary informed.
It is pertinent to mention here that objective behind obtaining daily work done statement is to keep close watch on the disposal of cases and evaluate the performance of the Judicial Officers.
Not only this, even directives on other important issues are not being complied with in letter and spirit and fate of instructions vis-a-vis computerisation of document registration in the State is the testimony of the same.
Vide Communication No.38607-29/Sts dated September 29, 2018, the High Court had sought district wise and court wise information relating to number of registrations done in the year 2017 (from January 1, 2017 to December 31, 2017) and amount of stamp duty used in these registrations.
Though it was specifically mentioned in the communication that matter may be treated as most urgent yet several Principal District and Sessions Judges have failed to act on the directives till date.
This is evident from the Letter No.40919-28/Sts dated October 16, 2018 addressed to Principal District and Sessions Judges of Anantnag, Budgam, Baramulla, Bhaderwah, Kulgam, Leh, Reasi, Kathua and Samba.
“The requisite information regarding computerization of document registration is still pending despite lapse of two weeks. In this connection, it is requested to furnish the consolidated information of all courts under your jurisdiction within shortest possible time”, read the latest communication.
“Unless all the Judicial Officers cooperate and initiate timely follow-up action the intent behind the latest directives of the Chief Justice cannot be achieved”, sources said and hoped that level of compliance will increase up to the satisfaction of the Chief Justice in the coming days.
