JAMMU, Aug 21: Judicial Magistrate Ist Class Ramnagar, Renu Dogra has awarded two years simple imprisonment to a bus driver, whose negligent driving had caused death of two persons and injuries to several other passengers about four years back.
After hearing counsel for the accused person namely Durga Dass, son of Karam Chand of Jandrari in Ramnagar tehsil and Public Prosecutor, Judicial Magistrate Ist Class observed, “from the whole evidence, it has come to the fore that accused was plying the offending vehicle at the time of occurrence in a rash and negligent manner”.
Observing that prosecution has been able to prove the offences under Sections 279, 337, 338 and 304-A RPC and 3/181 Motor Vehicle Act against the accused, the court convicted Durga Dass and awarded him simple imprisonment for two years and fine of Rs 2000 under Section 304-A RPC; six months simple imprisonment and fine of Rs 1000 under Section 338 RPC; simple imprisonment of one month and fine of Rs 500 under Section 337 RPC and simple imprisonment of two months and fine of Rs 1000 under Section 279 RPC.
“All the sentences shall run concurrently and in case of default in payment of the fine, the convict shall further undergo simple imprisonment for two months”, the court said.
