JAMMU, Oct 31: Principal Sessions Judge Bhaderwah M K Sharma today awarded 10 years rigorous imprisonment to Sanjay Kumar, son of Hans Raj of Bhaderwah in dowry death case.
After hearing both the sides, the court observed, “the convict has assassinated his young wife of 19 years. The deceased was the only daughter of her mother Darshana Devi, a widow. Darshana Devi, who had already lost her husband at a very young age has been deprived of her daughter also. As such lenient view is not required to be taken in imposing sentence”.
Accordingly, court awarded rigorous imprisonment for ten years to Sanjay Kumar for the commission of offence under Section 304-II RPC.
“The mother of the deceased on account of brutal murder of her only female child must have suffered tremendous amount of pain and agony. Realizing the need to provide some monetary amount to the victims of certain crimes including rape and murder etc or their dependents who had suffered loss or injury as a result of the crime, Jammu & Kashmir Victim Compensation Scheme and Sub Section I of Section 545 of CrPC have been made applicable to the State of J&K”, the court said.
As per the notification, different amounts have been mentioned for financial help to the victims of crime or their dependents. In case of murder, Rs one lakh has been provided as maximum limit of compensation which now as per SRO 394 dated 09.09.2013 revised to a maximum limit of compensation for loss of life and has been raised to Rs 2 lakh.
“A compensation of Rs 2 lakh will be just and reasonable amount for providing financial assistance to the mother of the deceased which shall be paid within one month by the Member Secretary, Jammu & Kashmir State Legal Services Authority”, the court directed.
