The tenders received late due to postal delay or due to any other reasons shall be responsibility of the tenderers & further all such tenders shall be rejected. The tenderers are required to submit their Registration Cards/certificates as well as sales Tax clearance certificates alongwith tender documents so as to verify its renewal.
Special conditions :-
1. The tenderer must see the site of work before casting of tender.
2. The work shall be executed as per administrative approval and to extra item shall be allowed during execution.
3. The Registration card of the contractor must be renewed for the current year.
4. The lowest tenderer will produce his Registration card in this office as and when called for allotment of work failing which his earnest money shall be frofeited.
5. The tender opening authority reserves the right to reject any or all the tenders without assigning any reason thereof.
6. The contractor who tendered such rates which will be found unworkable i.e. un-reasonable low or high shall not be accepted.
7. If there is holiday on last date of receipt of tender than working day will be treated as last date of receipt of tenders.
8. Intending tenderers shold use the tender documents nor each work in each envelop separatley. Tenders bulk in one envelop shall not be entertained.
9. Allotment shall be made only after receipts of funds.
10. The departmental material shall be issued to the contr.at stock issue rates.
11. The sales tax clearance certificate shall be submitted with the tender documents at the time of casting of tender in an accompany separate envelop.
12. Form the commencement to the taking over of the works by the Deptt. The contr. shall be responsible for any damage or loss to the work of part thereof caused due to any reason what so ever upto one year after completion. The contr. shall at his own cost repair & made good the loss or damages in every respect to the satisfaction of the engineers whose certificate in this behalf shall be conclusive proof of the defect etc having being removed.

The tenders should be sent either by post or delivered personally against proper receipt.
5. The rate quoted should be inclusive of all taxes, levies, freight/transportation and other charges at the point of delivery and stocking at Jammu. The rates should be written in both words as well as in figures without any over writing and cutting.
6. Quality/make of the article should be clearly indicated. In addition warranty/guarantee conditions of the equipment and after service facilities should be clearly specification in the offer.
7. The firm should mention as LST/CST Registration number in the quotation.
8. The purchaser can ask for a sample of the products offered for test and evaluation. This will be supplied without any obligation on the part of purchaser to accept the same. If the sample is found to conform to the laid down specifications this may be retained and the manufacturer / supplier may be asked to deliver the balance supplies along with the bills. In case of the rejection the sample may have to be collected by the supplier under his own arrangements.
9. The stores shall be supplied within 7 days from the date of issue of the supply order. In the event of the contractor’s / supplier’s failure to complete delivery by the date(s) specified in the contract/order, the purchaser may at his discretion withhold any payment until the whole of the stores have been supplied. If the contractor during the execution of the contract at any stage anticipates a delay in supplies beyond the agreed delivery schedule, he would promptly notify the purchaser, who may admit (as reasonable ground) for further time and grant an extension to the delivery schedule by issue of an amendment to the contract.
Liquidation damages may be imposed for defaults / inordinate delays on the part of contractor.
10. Bids shall remain valid for 90 days after the date of bid opening prescribed by the Purchaser. A bid valid for a shorter period may be rejected by the Purchaser as non-responsive.
11. Bidders should enclose alongwith the Bid offer, full details of the equipment offered with full documentation, descriptive literature, leaflets supplementing the description and point out any special feature of their system. All documents are required to be in English.
12. Payment of the stores supplied will be made ONLY ON BILLS BASIS after the stores have been received in full and in good condition as per the approved samples/specifications.
13. The purchaser reserves the right to negotiate with the lowest bidder after opening the bid.
14. The tender is not transferable.
15. No conditional tender shall be accepted. The tenderer imposing any condition shall strait way be rejected.
16. Tenders containing any overwriting / alteration will be summarily / rejected unless countersigned by authorized signatory.
17. Subsequent variation of price (after supply order is placed) will not be permissible.
18. DGP CID, J&K will have full powers to reject or accept any tender, part of the tender without assigning any reason and without any legal obligation. In case of any dispute the decision of this office will be final and binding.

1. Information to Tenderer
1. The Tender issue Authority reserves the right to refuse issue of Tender forms/Documents to any contractor if not satisfied with their proof eligibility without assigning any reason thereof.
2. The Tender received after the fixed date and time shall neither be opened nor considered at all. The date and time of Receipts of such Tenders would be marked on the envelope by the Tender Receiving Authority of his office representative. The disposal of the Tender document will be either return of this envelope to the contractor/firm casting the Tender or release of CDR but this will be done only after the concerned gives any undertaking for any of these two choices clearly mentioning that he would have no claim whatsoever over this contract. In case the Tenderer does not come forward with the undertaking the envelops will remain in safe custody till its final disposals.
Never this will not debar the department to proceed further in the matter to open other bids, allotment of the contract and take up the execution.
3. Tender not accompanied with the Earnest Money shall be rejected.
4. In case of ‘last’ day having been declared as Qazetted Holidays the next working day shall be considered as the last date of Receipt of Tenders.
5. The Tenderers shall not be entitled to any claim whatsoever on account of incurred on submission of the Tenders.
6. The Chief Engineer Irrigation and FC Department Jammu reserves the right to accept or reject any or all tenders without assigning any reason thereof and shall not be liable to any incumbrances.
7. The contractors shall have to mention the PAN on the Tender form otherwise his Tender shall be rejected at the time of openig of Tenders.
8. The contractor shall have to produce the Income Tax clearance certificate for the current financial year.
9. The Earnest Money/Deposit of the Successful Tenderers/contractors shall be returned and released after six months from the date of completion of the work in all respect and taken over by the Department.
10. The contractor quoting their Rates in Above/Below percentage of the sanctioned Schedule of Rates 2004 (not workable Rate) shall support their Rates with the Analysis by which they arrived at the said quoted rates otherwise their Tender shall be rejected without any reason.
11. The Departmental material of all sorts shall be issued to the contractors at the Prevelant stock Rates from time to time. However the present stock rates are as under :-
a) Cement at Rs 400/- (On cash payment).
b) Iron of all sorts at Rs 3500/- (on cash payment)
12. The contractor should start the work within seven days of issue of allotment letter. In case of failure to do so action under the Relevant clause of the NIT shall be taken.
Eligibility /Pre qualification
1. The intending Tenderers fulfill the following criteria be eligible to cast their tenders.
2. Attested copies of their Registration card duly renowned for the current year i.e 2008-09.
c) Certificate of Total turnover during the last two years for Rs 10.00 lacs for Civil works and its satisfactory completion from the competent Authorties. New card holder will provide the Details of work executed during the specified period in the lower class of Eligibility.

e) Ownership/Source of Procurement of Machinery Testing Equipment required for the execution Equipments required for the execution of work like Bulldozer, Excavator cum Loader, Truck/Tipper, water Tanker, concrete mix etc.
All other terms and conditions prescribed in the General and special conditions of the NIT in addition to the Form No. 25 shall be a part of the Agreement.

Any offer received after the due date shall not be entertained.
The tender documents can be obtained from the office of the undersigned against non-refundable cost of Rs.100/- only in the form of IPO/Cash/Demand Draft favoring Ex.Engineer. MHCHD, MED, Sgr.
The tender documents shall be issued to only those firms having the following pre-qualification and subject to production of certificates to the following effect;
1. The tender should have executed at least one such work costing not less than Rs.10.00 Lacs.
